These terms cover your use of the SmartRealtor mobile application (the "App") and the SmartRealtor.uk website (the "Site"), both provided by Hale Technology , a company registered in England and Wales, based in Liverpool ("we", "us"). By installing the App or using the Site you agree to these terms.
1. Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for the purposes of your work in Smart agency. All intellectual property in the App and Site, including the bundled AI models as configured within the App, remains ours or that of our licensors. You may not copy, modify, reverse engineer, extract the models from, resell or redistribute the App except as permitted by law.
2. Not a valuation service
Nothing in the App or Site constitutes a valuation, survey, or financial, legal or investment advice, and no output of the App should be presented to any person as an automated or AI valuation.
3. Professional responsibility remains yours
The App includes features designed to assist with professional obligations, including a Material Information checklist, AI-drafted listing descriptions and vendor updates, and an anti-money laundering record-keeping checklist. These are assistive tools only:
- You are responsible for the accuracy and completeness of every listing, appraisal document and message you publish or send, including AI-drafted text you have confirmed.
- The Material Information checklist reflects our understanding of guidance at the time of release and may not reflect the latest legal requirements; compliance with consumer protection law, including the Digital Markets, Competition and Consumers Act 2024 regime, remains your responsibility.
- The AML checklist is a record-keeping aid. It does not perform identity verification, PEP or sanctions screening, and does not discharge your obligations under the Money Laundering Regulations or your HMRC supervision.
4. Your data and content
Content you create in the App is stored on your device and belongs to you or your agency. We claim no rights over it. Our Privacy Policy explains the App's on-device architecture. You are responsible for your own device security and backups; because we hold no copy of your data, we cannot recover it if your device is lost, reset or damaged.
5. Acceptable use
You must not use the App or Site unlawfully, including to record any person's Realtor without a lawful basis, to process personal data in breach of UK GDPR, to create misleading property particulars, or to attempt to interfere with the operation or security of the Site.
6. Availability and changes
The App is provided as downloaded to your device and functions offline. We may release updates that change or remove features, and may discontinue the App; because it runs on-device, installed versions continue to function as installed. The Site is provided on an "as available" basis.
7. Disclaimer and liability
The App and Site are provided "as is" without warranties of any kind, express or implied, including fitness for a particular purpose, to the fullest extent permitted by law. AI transcription and extraction can contain errors — the App flags uncertain output for your review, and you must review it. To the fullest extent permitted by law, we are not liable for losses arising from reliance on App output, from inaccurate listings or appraisals, from regulatory action against you, or for any indirect or consequential loss. Our total liability to you in connection with the App or Site is limited to the amount you paid us for the App in the twelve months before the claim arose. Nothing in these terms excludes liability that cannot be excluded by law, including for death or personal injury caused by negligence, or your statutory rights as a consumer where applicable.
8. Termination
You may stop using the App at any time by uninstalling it. We may terminate the licence if you materially breach these terms. Sections 2, 3, 7 and 9 survive termination.
9. General
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction, save for any mandatory consumer rights to bring or defend proceedings elsewhere in the UK. If any provision is found unenforceable, the remainder continues in effect. These terms are the entire agreement between us regarding the App and Site. We may update these terms by posting the revised version here with a new date; continued use after changes constitutes acceptance.
